Policy Wording Controls — The First Line of Defence

Disability Definition — Own, Any or Suited Occupation The disability definition is the most financially consequential wording element. "Own occupation" (inability to perform the insured's specific job) is the most generous to claimants and appropriate for high-income professionals. "Any occupation" (inability to perform any job for which educated/trained) is the most restrictive. "Suited occupation" is an intermediate standard. Underwriters must match the definition to the risk profile — mismatched definitions are a primary source of disputes and claims leakage. VER
Pre-Existing Condition (PEC) Exclusions Three standard approaches: (1) Full exclusion — any PEC excluded forever, regardless of treatment. (2) Moratorium underwriting (MORI) — conditions present in the 5 years pre-inception are excluded for the first 2 years; if claimant is symptom/treatment-free for 2 years they become covered. (3) Individual Medical Underwriting (IMU) — each condition individually assessed and accepted, excluded or rated. IMU gives certainty but requires disclosure; MORI is simpler at inception but creates disputes at claim stage. VER
Pandemic / Epidemic Exclusion Clause Post-COVID, epidemic/pandemic exclusions are standard across travel (KT) and are being inserted into group A&H products where absent. Standard wording excludes losses arising from any communicable disease declared a Public Health Emergency of International Concern (PHEIC) by WHO, or any national epidemic/pandemic declaration. The scope of "arising from" is critical — direct infection vs. consequential lockdown/cancellation losses are often treated differently. VER
Mental Health Exclusions — FCA Consumer Duty Scrutiny Historical travel and income protection wordings contained blanket mental health exclusions or significant limitations. Post-Consumer Duty (2023), these exclusions require justification as providing good consumer outcomes. FCA has specifically challenged mental health exclusions in travel insurance (denying cover for trip cancellation triggered by documented mental health conditions). Insurers must document the rationale for any mental health limitation or face regulatory challenge. VER

Underwriting Controls by Sub-Class

Personal Accident (KA)

  • Occupation class verification (payslips, HMRC records)
  • Leisure/sports activity declaration at inception
  • Maximum benefit as proportion of earnings (typically 60–70%)
  • Deferred period to eliminate moral hazard
  • Aggregate stop-loss for high-sum-insured risks
  • War and terrorism exclusion (buyback available)

Group PMI / Medical Expenses (KG/KC)

  • Free cover limit (below limit: no medical evidence; above: IMU required)
  • Annual aggregate deductible / co-payment
  • Hospital approved list / guided network
  • Out-patient benefit caps and sub-limits
  • Age-banded contribution structure
  • Medical inflation annual adjustment (automatic or re-rate)
  • Cosmetic/elective exclusions defined clearly

Travel Insurance (KT)

  • FCDO travel advice trigger — cancellation only where FCDO advises against travel
  • Pre-existing medical conditions: screen and rate or exclude
  • Trip duration limits (e.g. 31 days, 60 days per trip)
  • Winter sports extension (separate premium)
  • Pandemic/epidemic exclusion
  • Alcohol / illegal substance exclusion
  • Hazardous activities exclusion list
  • Policy excess / co-payment (typically £50–£200)

Sports Disability (KS)

  • Medical examination and sports-specific fitness assessment
  • Prior injury exclusions (site-specific for previously injured joints/areas)
  • Playing position rating (props higher than backs in rugby)
  • Aggregate limit per team/squad programme
  • Waiting / elimination period (typically 26–52 weeks)
  • Rehabilitation obligation clause (failure to rehabilitate may void claim)
  • Concussion/head injury protocol — independent neurological assessment

Maritime PA / Crew K&R (KM)

  • MLC 2006 compliance check — mandatory crew medical and welfare obligations
  • War/piracy territory exclusions and war risk loading (JWC HRA areas)
  • Pre-employment medical (PEM) standard
  • K&R: silence obligation — ransom and crisis response protocols
  • Coverage coordination with P&I Club (employer liability vs. PA)
  • Repatriation plan and medical evacuation logistics confirmed

Creditor Protection (KP)

  • FCA PROD product governance — genuine customer need assessment
  • Benefit is capped at loan repayment amount (indemnity basis)
  • Employment status at inception declared (self-employed usually excluded for unemployment benefit)
  • Waiting period: typically first 30–60 days of disability not covered
  • Pre-existing conditions: 12–24 month look-back exclusion
  • Fair value assessment required under Consumer Duty

Rehabilitation Services — Reducing Disability Duration

Early intervention and active rehabilitation management is the most effective tool for reducing average disability claim duration. Industry data consistently shows that early case management reduces group income protection claim duration by 20–40%. EST

Long-COVID Rehabilitation Challenge Long-COVID presents a specific rehabilitation challenge: the condition is heterogeneous (symptoms vary widely between individuals), lacks a clear treatment protocol, and does not respond well to standard graded exercise therapy (GET) — which can worsen fatigue in some patients. Insurers managing long-COVID disability claims should use COVID-Specific post-COVID clinics (NHS established 90+ post-COVID clinics by 2022), paced activity management (not standard GET), neuropsychological assessment for cognitive impairment, and respiratory physiotherapy where indicated. Regulatory Framework & Standards

Standard / RegulationScopeRelevance to PA&H
FCA Consumer Duty (July 2023)UK retail financial products including A&H4 good outcome pillars: product & services, price & value, consumer understanding, consumer support. IPID must be clear; exclusions must be justified; claims must be paid promptly
Insurance Act 2015UK commercial insurance (PA/KG)Fair presentation duty — insured must disclose all material circumstances. Replaces old duty of utmost good faith. Proportionate remedy for breach (not automatic avoidance)
Consumer Insurance Act 2012UK retail/personal insurance (KA/KT)Duty to take reasonable care not to make misrepresentation. Careless misrepresentation = proportionate remedy. Deliberate/reckless = avoidance
MLC 2006 (Maritime Labour Convention)Seafarers / crew worldwideMandatory medical examination, repatriation rights, sickness benefit obligations for shipowners. KM policies often provide insurance backing for MLC crew welfare obligations
ACA (Affordable Care Act 2010)USA health insurance marketProhibits PEC exclusions, mandates essential health benefits, extends coverage to age 26 on parents' plan. Relevant for Lloyd's syndicates writing US health-related excess of loss
GDPR / Data Protection Act 2018Health data processing (UK/EU)Health data is special category data (Article 9 GDPR). Explicit consent required for processing medical information in underwriting and claims. Affects wearable data, medical record access
Equality Act 2010UK; discrimination in insuranceAge and disability must be actuarially justified if used as rating factors. Mental health disability protected. Blanket mental health exclusions require justification
CMI (Continuous Mortality Investigation)UK actuarial mortality/morbidity dataProvides the morbidity tables underlying PA&H pricing. CMI publishes annual working papers on long-COVID, mental health and disability trends
